TenderWorld Delivery Information
This Delivery Information (hereinafter referred to as "this Information") is a clear statement made by TenderWorld (hereinafter referred to as the "Platform") regarding the international logistics and delivery of products on the Platform. It aims to define the rights and obligations among the Platform, Users and logistics service providers. By using the delivery services of the Platform, the User is deemed to have fully read, understood and voluntarily accepted all the contents of this Information and voluntarily abided by the relevant agreements.
I. Delivery Scope
1.1 The Platform only provides international logistics and delivery services to legally valid overseas addresses, which specifically refer to countries and regions outside the People's Republic of China (including the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Region of China).
1.2 The Platform explicitly does not provide delivery services to any address within the territory of the People's Republic of China (excluding the Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Region of China). It is strictly prohibited to deliver products to domestic residential addresses, office addresses, transit warehouse addresses, collection point addresses and other various addresses located within the territory of the People's Republic of China. If the delivery address provided by the User is a domestic address, the Platform has the right to refuse to perform its obligations, cancel the relevant order and refund the paid funds in accordance with the original payment method, without bearing any additional liability.
1.3 The User warrants that the overseas delivery address provided by him/her is true, legal and valid and can normally receive international logistics packages. If the delivery fails, is delayed or the package is lost due to incorrect, invalid or incomplete address, the relevant losses shall be borne by the User himself/herself.
II. Delivery Entity and Cooperation Norms
2.1 The Platform entrusts third-party logistics service providers (hereinafter referred to as "Logistics Service Providers") with legal international logistics qualifications and cross-border logistics operation capabilities to undertake the product delivery obligation. The selection, cooperation and management of Logistics Service Providers shall be the responsibility of the Platform.
2.2 The Logistics Service Provider shall carry out relevant work such as product transportation, customs declaration and package delivery in accordance with the Platform's agreements, the requirements of this Information and the relevant laws and regulations of the People's Republic of China and the destination country/region outside China. The Platform supervises the service quality of the Logistics Service Provider but does not directly participate in the specific operations of the logistics and transportation link.
2.3 The Platform has the right to adjust the cooperating Logistics Service Providers according to factors such as logistics efficiency, service quality and compliance requirements. After the adjustment, the Platform will notify the User through a platform announcement. The User's continued use of the delivery service shall be deemed as acceptance of the adjusted Logistics Service Provider and relevant service standards.
III. Delivery Time Limit and Process
3.1 The delivery time limit shall be subject to the estimated time limit displayed on the order details page when the User places the order. This time limit is calculated based on the logistics route, customs clearance cycle, Logistics Service Provider's capacity and logistics efficiency of the destination country/region. It is for reference only and does not constitute a performance commitment of the Platform.
3.2 Delivery Process: After the User pays the order amount, the Platform completes product preparation and packaging and hands it over to the Logistics Service Provider; the Logistics Service Provider completes product collection, customs declaration and international transportation, and after arriving at the overseas destination, completes customs clearance and delivers it to the User's designated delivery address; the delivery process is completed after the User or his/her authorized recipient confirms receipt of the goods.
3.3 If the delivery time limit is extended or delivery fails due to force majeure (such as natural disasters, wars, riots), policy adjustments of the destination country/region outside China, customs clearance delays, tight logistics capacity, holidays, epidemics and other reasons not attributable to the Platform and the Logistics Service Provider, the Platform and the Logistics Service Provider shall not bear liability for breach of contract. The Platform will promptly notify the User of the relevant situation and assist the User in following up and handling it.
IV. Delivery Confirmation and Inspection
4.1 Confirmation of Delivery Completion: After the Logistics Service Provider delivers the goods to the designated overseas delivery address and obtains the signature confirmation, electronic signature of the User or his/her authorized recipient or other forms of signature recognized by the destination country/region outside China, the delivery shall be deemed completed and the Platform has fulfilled its delivery obligation.
4.2 Product Inspection: When signing for the goods, the User or his/her authorized recipient shall inspect the quantity, appearance and integrity of the goods on the spot. If any damage, shortage, deformation, inconsistency with the order or other abnormalities are found in the goods, the User or his/her authorized recipient shall take photos and videos on the spot to retain evidence, and promptly notify the Logistics Service Provider and the Platform. At the same time, the User shall submit relevant supporting materials (including photos, videos, logistics documents, etc.) in writing within 3 working days after signing for the goods. The Platform will coordinate with the Logistics Service Provider to verify and handle it.
4.3 If the User or his/her authorized recipient does not inspect the goods on the spot, or does not raise an objection and submit supporting materials within the above-mentioned time limit after signing for the goods, it shall be deemed that the goods have been delivered intact and accurately, and the Platform and the Logistics Service Provider shall no longer bear the relevant inspection, verification and compensation liabilities.
V. Customs Clearance Related Agreements
5.1 The User shall truthfully and accurately provide the information required for customs clearance (including but not limited to the User's identity information, product name, specification, quantity, declared value, purpose, etc.) in accordance with the customs regulations of the destination country/region outside China. The User shall not provide false or forged customs clearance information or evade customs supervision.
5.2 The Platform and the Logistics Service Provider will assist the User in submitting relevant customs clearance materials in accordance with the customs clearance requirements, but shall not bear the main responsibility for customs clearance. If the customs clearance fails, the package is detained, confiscated, fined or other related losses are caused due to inaccurate or incomplete customs clearance information provided by the User, or violation of the customs policies and laws and regulations of the destination country/region outside China, the relevant losses shall be borne by the User himself/herself. The Platform shall not bear any compensation liability, nor shall it bear the relevant coordination and remedial obligations.
5.3 The relevant taxes and fees such as customs duties, value-added taxes and consumption taxes incurred during the customs clearance process shall be borne by the User. The specific tax and fee standards shall be subject to the verification of the customs of the destination country/region outside China. The User shall promptly pay the relevant taxes and fees in accordance with the requirements of the customs. If the package is detained or returned due to failure to pay the taxes and fees on time, the relevant losses shall be borne by the User himself/herself.
VI. Risk Transfer and Liability Division
6.1 The risk of damage, loss, theft, etc. of the goods shall be transferred to the User from the date when the Platform delivers the goods to the Logistics Service Provider for collection. Except for the losses caused by the intentional or gross negligence of the Platform or the Logistics Service Provider, the User shall bear all risks and losses incurred during the transportation, customs clearance and delivery of the goods.
6.2 If the goods are damaged, lost or delivered late due to the operational error, intent or gross negligence of the Logistics Service Provider, the Logistics Service Provider shall bear the corresponding compensation liability. The Platform will assist the User in claiming compensation from the Logistics Service Provider but shall not directly bear the compensation liability. The User shall cooperate with the Platform and the Logistics Service Provider to provide relevant evidence and assist in the compensation claim work.
6.3 If the delivery fails, the package is lost, delayed or other losses are caused due to the User's own reasons (such as incorrect address, invalid contact information, failure to sign for the goods in a timely manner, refusal to cooperate with customs clearance, etc.), the relevant losses shall be borne by the User himself/herself, and the Platform and the Logistics Service Provider shall not bear any liability.
VII. Provisions on Prohibited and Restricted Items
7.1 The User shall ensure that the purchased goods do not belong to the prohibited or restricted items specified by the People's Republic of China and the destination country/region outside China, including but not limited to flammable and explosive items, toxic and harmful items, controlled utensils, prohibited drugs, infringing goods and other items that violate relevant laws and regulations.
7.2 If the goods purchased by the User are prohibited or restricted items, resulting in the package being rejected by the Logistics Service Provider, detained, confiscated or subject to other disposal measures by the customs, the relevant losses shall be borne by the User himself/herself. The Platform has the right to cancel the relevant order and refund the paid funds in accordance with the original payment method (excluding the incurred costs such as goods preparation, logistics and customs declaration), without bearing any liability for breach of contract.
VIII. Other Instructions
8.1 This Information is a supplement to the relevant agreements on the Platform's services and has the same legal effect as the Platform's "Terms of Service", "Privacy Policy" and other relevant rules. If there is any inconsistency between this Information and the above-mentioned rules, this Information shall prevail. For matters not covered by this Information, they shall be implemented in accordance with relevant laws and regulations and the Platform's rules.
8.2 The Platform has the right to revise the content of this Information according to factors such as business development, compliance requirements and changes in international logistics policies. After the revision, the Platform will publish it through a platform announcement. It shall take effect after the expiration of the publication period. The User's continued use of the Platform's delivery services shall be deemed as acceptance of the revised Information.
8.3 If the User has any questions, complaints or needs regarding delivery-related matters, he/she may contact the Platform through the Platform's customer service email (qiyue@zhiyutrade.com.cn). The Platform will respond within 3 working days and give a clear handling result within 15 working days.
